StrTalk Terms of Service

Last updated: [DATE]

These terms are the agreement between you and [LEGAL ENTITY NAME], [REGISTERED ADDRESS], [COUNTRY], registered as [COMPANY REGISTRATION NUMBER] ("we", "us") for use of the StrTalk app. By connecting your wallet and signing in, you accept them. If you do not accept them, do not use StrTalk.

1. What StrTalk is

StrTalk is an end-to-end encrypted messaging app. Your identity is a STR domain you own on the Polygon blockchain, and you sign in by proving ownership with your wallet.

StrTalk is a communication service. It is not a wallet, an exchange, a custodian, or a financial service. We never take custody of your cryptocurrency, your STR domain, or your private keys, and StrTalk cannot move, spend, or transfer any asset you hold.

StrTalk cannot be used to call emergency services. It provides no access to 112, 911, or any other emergency number, and it cannot pass your location to emergency services. It is not a replacement for a telephone service. Always use your phone's normal dialler in an emergency.

2. Eligibility

You must be at least 18 years old and legally able to enter into this agreement. StrTalk is not offered to children. You need a compatible cryptocurrency wallet and a STR domain, which you obtain separately — acquiring one is not part of this agreement and is governed by its own terms.

3. Your account

Your account is tied to the STR domain you own. If your STR domain is transferred or sold, the StrTalk identity attached to it goes with it, and your access ends. Section 9 explains what happens then, and how to challenge it if we get it wrong.

An account can be signed in on one phone at a time. Signing in on a new phone signs out the previous one.

You are responsible for your wallet, your private keys, and your recovery key. We cannot recover any of them. Losing your wallet means losing access to your account, and losing your recovery key with no signed-in device means losing your encrypted message history permanently. This is a consequence of encryption we cannot bypass, not a support limitation, and it is a deliberate design choice we are telling you about before you rely on the service.

Keep your device secured. Anyone with access to a signed-in device can read your messages.

4. Acceptable use

You may not use StrTalk to:

Our full Acceptable Use Policy is at [ACCEPTABLE USE POLICY URL] and forms part of these terms.

5. Moderation: what we can and cannot do

We want to be precise about this, because the honest answer is unusual.

We cannot read your messages. They are end-to-end encrypted, and we hold no key. There is no scanning, no filtering, and no automated content review, because there is nothing for us to review. We are not going to add a backdoor to make moderation easier.

What we can act on is therefore limited to: reports from people in a conversation, the metadata and abuse patterns visible at the infrastructure level, and lawful orders from an authority with jurisdiction over us.

Reporting. You can report a single message, or report the person, from inside the app, or write to support@strtalk.sourceless.net. Anyone — including people who do not use StrTalk — can report illegal content to us at abuse@strtalk.sourceless.net, and we will tell you what we decided about anything reported that way. We review every report we receive, but we do not send an individual reply to each one.

Blocking. You can block any account, which stops their messages and calls reaching you, without involving us at all. This is usually faster and more effective than a report.

What we may do in response to a substantiated report or to abuse we detect: warn you, remove your ability to use a feature, suspend your account, or terminate it. We choose the least restrictive measure that addresses the problem.

6. Your content

Your messages remain yours. We claim no ownership.

You grant us only the narrow permission needed to run the service: to store, transmit, and deliver your content to the people you send it to. Since content is end-to-end encrypted, in practice this means relaying data we cannot read.

You are responsible for what you send, and for having the right to send it.

7. Suspension and termination

We may suspend or terminate an account that breaches these terms, that is used to attack the service, or where we are legally required to act.

We will tell you why. When we suspend or terminate your account, we will give you a statement of the reason, the facts we relied on, whether the decision was made by a person or automatically, and how to challenge it — unless the law prohibits us from telling you.

You can challenge it. Write to support@strtalk.sourceless.net and a person who was not involved in the original decision will review it. If you disagree with the outcome you can take the matter to a court in your country of residence, and if you are an EU consumer you may also be able to use an out-of-court dispute settlement body.

You can stop using StrTalk at any time and delete your account from Settings -> Account -> Delete your account, or at [DELETION PAGE URL]. What deletion covers, and what it cannot reach, is described in the Privacy Policy.

8. Complaints

If you are unhappy with anything about the service — a moderation decision, a deletion that did not work, how we handled a request — write to support@strtalk.sourceless.net.

You always keep the right to complain to your data protection authority ([SUPERVISORY AUTHORITY]) about how we handle your personal data, and to bring proceedings in your own country.

9. If your STR domain changes hands

We monitor the Polygon blockchain for transfers of STR domains. When we detect that your STR domain has left your wallet, the StrTalk account bound to it is deactivated and its data erased, and the new owner starts with a fresh, empty account. This protects the new owner and prevents a previous owner regaining access.

This is an automated decision with a serious effect, so:

10. Service availability

We work to keep StrTalk running but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features. If we discontinue the service entirely we will give at least [DISCONTINUATION NOTICE PERIOD] notice so you can retrieve what matters to you.

We will provide security updates for StrTalk for at least [SECURITY SUPPORT PERIOD] from the date of each release.

StrTalk is provided "as is". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. If you are a consumer, this does not affect your legal rights, including your right to a service that conforms to what we described.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or unforeseeable loss, or for loss of profits, data, or cryptocurrency assets.

We are specifically not liable for: loss of your wallet, private keys, or recovery key; the value or transferability of your STR domain; anything done by your wallet provider or the Polygon network; or the conduct of other StrTalk users.

Our total liability for any claim is limited to [AMOUNT — StrTalk is currently free, so this is typically a nominal sum or amounts paid in the preceding 12 months].

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or intentional breach. If you are a consumer, your statutory rights are unaffected by these terms, and any term that would deprive you of a mandatory protection under the law of your country of residence does not apply to you.

12. Blockchain risks

StrTalk depends on the Polygon network and on your wallet, neither of which we operate or control. Network outages, congestion, forks, changes to the STR domain contract, or a compromise of your wallet can all affect your access to StrTalk, and none of them are within our power to fix.

13. Open source

StrTalk is built on open source software. The licences and required notices are at [OPEN SOURCE NOTICES URL] and in the app under Settings -> About -> Open source licences. Some of that software is licensed under the GNU Affero General Public License; where that applies, the corresponding source is offered at [SOURCE OFFER URL].

14. Changes to these terms

We may update these terms. For material changes we will notify you in the app at least [CHANGE NOTICE PERIOD] before they take effect, and tell you what changed. If you do not accept the new version you can delete your account before it takes effect, and if the change significantly disadvantages you, you may end this agreement at any time without cost.

We will not change these terms retroactively.

15. Governing law

These terms are governed by the laws of [JURISDICTION]. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there, and we will bring any proceedings against you only in the courts of your country of residence.
